MEDICALLDESK TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing, using, or subscribing to Medicalldesk.com ("Medicalldesk," "we," "our," or "us"), you ("Client," "Subscriber," "you," or "your") agree to be legally bound by these Terms of Service ("Terms"). These Terms constitute a binding agreement between you and Medicalldesk.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR SERVICES.

Your continued use of the Services after any modifications to these Terms constitutes acceptance of those changes.

2. DEFINITIONS

"Services"

means the AI-powered receptionist services, including but not limited to call answering, appointment scheduling, FAQ handling, calendar integration, SMS notifications, and related business communication features provided by Medicalldesk.

"AI Receptionist"

means the automated voice system powered by artificial intelligence that answers calls on behalf of your practice.

"Client Data"

means information you provide about your practice, including business hours, staff information, services offered, policies, and procedures.

"Patient Information"

means basic contact and scheduling information collected from callers, including name, phone number, email, date of birth, insurance provider, and reason for visit.

"PHI" (Protected Health Information)

means individually identifiable health information as defined under HIPAA, including medical records, treatment history, diagnoses, and detailed health conditions.

"Business Associate Agreement (BAA)"

means the separate HIPAA compliance agreement required for HIPAA-covered entities.

3. SCOPE OF SERVICES

3.1 Services Provided

Medicalldesk provides AI-powered receptionist services designed to:

  • Answer inbound business calls 24/7
  • Schedule, reschedule, and cancel appointments
  • Check calendar availability in real-time
  • Answer frequently asked questions about your practice
  • Collect basic patient information for appointment booking
  • Send SMS appointment confirmations
  • Transfer calls to appropriate staff members when necessary
  • Handle multiple calls simultaneously

3.2 Services NOT Provided

Medicalldesk Services are NOT:

  • A substitute for emergency medical services (911)
  • Medical advice, diagnosis, or treatment
  • A replacement for human clinical judgment
  • Designed to handle life-threatening emergencies
  • A substitute for professional medical consultation
  • Able to provide specific medical information about conditions or treatments

3.3 Intended Use

Services are intended exclusively for business communication purposes related to appointment scheduling and general practice information. Services are not intended for, and must not be used for, emergency medical situations or clinical decision-making.

4. SUBSCRIPTION PLANS & PRICING

4.1 Available Plans

Essential Plan:

  • Introductory Rate: $700/month for first 3 months
  • Standard Rate: $1,000/month thereafter
  • Includes: AI receptionist service, call forwarding setup, HIPAA-compliant handling, Google Calendar integration, SMS confirmations, 24/7 availability

Professional Plan:

  • Introductory Rate: $900/month for first 3 months
  • Standard Rate: $1,200/month thereafter
  • Includes: All Essential Plan features plus multilingual support in 10 languages (English, Spanish, French, German, Hindi, Russian, Portuguese, Japanese, Italian, Dutch)

4.2 Automatic Rate Adjustment

You acknowledge and agree that subscription rates automatically increase from introductory to standard rates after the first 3 billing cycles. You will receive notification 7 days prior to the rate increase.

4.3 Billing Terms

  • Payment is due within 24 hours of service agreement execution
  • Recurring monthly billing is automatically charged to your payment method on file
  • All fees are non-refundable except as explicitly stated in Section 12
  • You authorize Medicalldesk to charge your payment method for all fees incurred

4.4 Late Payment & Suspension

  • Accounts with payment failures receive immediate notification
  • Service may be suspended after 5 business days of non-payment
  • A $50 reactivation fee applies to suspended accounts
  • Medicalldesk reserves the right to terminate accounts with repeated payment failures

4.5 No Hidden Fees

Monthly subscription includes unlimited calls and minutes. There are no per-call, per-minute, or usage-based charges beyond the flat monthly rate.

18. ACKNOWLEDGMENT & ACCEPTANCE

BY USING MEDICALLDESK SERVICES, YOU ACKNOWLEDGE THAT:

  1. You have read and understood these Terms of Service
  2. You agree to be bound by all provisions contained herein
  3. You accept all disclaimers and limitations of liability
  4. You understand the Services are not for emergency use
  5. You will maintain human oversight for all clinical decisions
  6. You authorize Medicalldesk to charge your payment method for all fees incurred
  7. You understand all fees are non-refundable except as stated
  8. You will use the Services only for lawful business purposes
  9. You have authority to bind your practice to these Terms
